Terms of Service

1. Acceptance

By downloading or using MagicPhoto ("the App"), you agree to these Terms of Service. If you do not agree, do not use the App.

2. Eligibility

You must be at least 13 years old (or the minimum digital age in your country) to use the App. By using MagicPhoto you confirm you meet this requirement.

3. Account

Accounts are created exclusively via Sign in with Apple. You are responsible for keeping your Apple ID secure. You may delete your account at any time from the in-app Settings.

4. Credits & Payments

Credits are purchased exclusively through Apple In-App Purchase.
Credits are a limited license to use AI processing inside the App; they have no cash value, are non-transferable and non-refundable except where required by law or Apple's policies.
Each enhancement deducts credits only when processing succeeds. If processing fails, credits are restored automatically.
Refund requests are handled by Apple in accordance with the App Store policy.

5. Acceptable Use

You agree NOT to use the App to:

Upload content you do not own or have the right to use.
Upload sexual, violent, hateful, or otherwise unlawful content, including content depicting minors inappropriately.
Generate deceptive deepfakes, impersonate real people without consent, or create content intended to deceive or defraud.
Reverse-engineer, scrape, or abuse the service or its API.

We may suspend or terminate accounts that violate these rules. We follow a zero-tolerance policy for objectionable content and abusive users, in line with Apple App Store Review Guideline 1.2.

6. User Content

You retain ownership of the photos you upload and the enhanced outputs. You grant us a limited license to host, process, and deliver your content solely to provide the service. We do not use your content to train AI models.

7. Content Moderation & Reporting

You can report objectionable content or abusive users from within the App. Reports are reviewed within 24 hours and offending content or users are removed.

8. Intellectual Property

The App, its design, code, and trademarks are owned by MagicPhoto and protected by applicable laws. These Terms do not grant you any rights to our trademarks.

9. Disclaimers

The App is provided "AS IS" without warranties of any kind. AI outputs may contain errors or artifacts. You are responsible for how you use the generated content.

10. Limitation of Liability

To the maximum extent permitted by law, MagicPhoto is not liable for any indirect, incidental, or consequential damages. Our aggregate liability shall not exceed the amount you paid us in the 12 months prior to the claim.

11. Termination

We may suspend or terminate your access if you breach these Terms. You may stop using the App at any time.

12. Changes

We may update these Terms from time to time. Continued use after changes means you accept the updated Terms.
